P.E.A.N.U.T.S. Constitution
ARTICLE I. Our Name
-The name of this organization shall be P.E.A.N.U.T.S., an acronym for: Planning Exciting Activities for a Never-ending Utopia for The College of New Jersey Students.
ARTICLE II. Mission Statement
-The mission of P.E.A.N.U.T.S. is to provide The College of New Jersey community with fun activities that are alcohol and drug free in nature. We strive to attract individuals who wish to participate in such activities and who are willing to aid in the growth of the organization.
ARTICLE III. Membership
-Anyone affiliated with The College of New Jersey may become a member. This includes faculty, staff, and both undergraduate and graduate students.
-Members need not to adhere to a certain lifestyle; however, we require a sober body and open mind at all meetings and events.
-Membership shall be divided into four sections: E-Mail List, Informal Member, Core Members and Executives (See Bylaws, Article B-11).
ARTICLE IV. General Event Voting
-Voting is to be run by the President.
-Simple majority is needed to pass a vote.
-Anyone present at the meeting may vote.
-See ARTICLE V for procedures for officer elections.
ARTICLE V. Elections of Officers
-Elections are conducted by the Executive Vice President, except for any positions the Executive Vice President is running for (See ARTICLE VII, Section 2).
-Elections are held the third to the last general meeting of the Fall semester, or as otherwise required (determined by the President).
-Nominations take place two weeks prior to the elections.
-One may nominate oneself or someone else. There must be a second to the nomination, the nomination must be accepted, and the nominee must give a five minute maximum speech immediately before the election.
-All election processes are run from the top of the slate, down.
-One-half of the core members must be present for an election; if not, then the election is run at the next meeting, regardless.
-Only undergraduate students may run for executive office, unless no undergraduate student decides to run for that position.
-Newly elected officers begin their term immediately after the election, unless otherwise specified by the sitting President.
-Should the office of
President be left vacant after an election, the Executive Board will
appoint a core member that qualifies for the position. If an
executive member is appointed, their position will be filled by
appointment of core members by the Executive
Board.
-Newly elected executives must read the Constitution, Bylaws and Budget upon assuming their positions.
ARTICLE VI. Officers of the Organization
-The Executive Board shall consist of the following officers:
-President
-Executive Vice President
-Vice President of Activities
-Treasurer
-Secretary
-Vice President of Membership and Publicity
Article VII. Officer Responsibilities
-Section 1: President
-Runs Executive and General Membership meetings (see Bylaws, Article B-III).
-Oversees the whole organization.
-Can serve as ex-officio on all groups.
-Represents club at Student Government Association meetings if necessary.
-Inspirational leader of the group who follows the Mission Statement.
-Responsible for equal delegation of duties.
-Section 2: Executive Vice President
-Runs officer elections, except for any positions he/she is running for.
-Head of Constitution and Bylaws committee and handles any proposed changes (see Bylaws, ARTICLE B-V)
-Reports to President.
-Next in line to President.
-Plans and facilitates weekly fun activity at meetings.
-Section 3: Vice President of Activities.
-In charge of organizing committee chairs, and overseeing all their activities (See Bylaws, ARTICLE B-IX).
-Reports to the Executive Board and at general meetings about upcoming events.
-Reports to the Executive Vice President.
-Third to President.
-Section 4: Treasurer
-Creates a budget early in the Spring semester
-Must approve Fundraising Committee Chair when applicable
-Reports to the Executive Vice President
-Unless expressed authorization is given by the treasurer to another member, all funds shall be held by the treasurer.
-Fourth to President
-Section 5: Secretary
-Keeps membership roll
-Takes roll at all meetings
-Keeps record of membership attendance percentages
-Takes minutes at all meetings and has a record of all minutes
-Responsible for all e-mail
-Reports to the Executive Vice President
-Fifth to President
-Section 6: Vice President of Membership and Publicity
-In charge of group advertising, and may organize committees as needed
-In charge of activities Fair stand
-Has direct contact with all campus media publications
-Reports to the Executive Vice President
-Maintains web page
-Sixth to President

ARTICLE B-I. Elections of Officers
-The responsibilities of each office will be read from the Constitution prior to nominations
-No write-ins are allowed
-The vote is conducted with a written secret ballot and is tallied by the highest of two officers not running for re-election. In the event that fewer than two officers are not running for re-election the eldest core members shall tally the ballots.
-The person with the most votes wins
-The elections will be held the third to last meeting of the fall semester, unless conditions stated in Article 5 supercede this.
-For the remainder of the semester the members of the previous executive board shall be required to attend the executive board and general meetings in an advisory capacity for the newly elected executive board members.
ARTICLE B-II. Qualifications for Membership
-Section 1: E-mail List Members
-Anyone who signs up at events such as the Activities Fair shall become E-Mail List members.
-They shall remain on the mailing list for one full year unless they ask to be taken off.
-Section 2: Informal Members.
-Anyone who attends at least one P.E.A.N.U.T.S. meeting shall be considered an informal member.
-Section 3: Core Members.
-Each semester, anyone who attends fifty percent of the weekly general meetings shall be considered a core member.
Section 4: Executives.
-In order to run for an Executive seat, one must be a core member for at least one full semester. An acceptation to this can be made if no one meeting this criterion wishes to run. In which case a core member for less than a semester can run and be elected.
-Term of office of all Executives is one year, renewable through the election process.
-All Executives must be undergraduate students at The College of New Jersey (See ARTICLE V).
-Executives must attend two-thirds of all meetings and make every effort to attend as many activities as possible.
-Any Executive can motion to remove any fellow Executive from office with a three-fourths core membership majority vote for any Major Law Violation (See Bylaws, ARTICLE B-IV).
-Section 5: Discrimination Policy.
-It is hereby acknowledged that P.E.A.N.U.T.S. insures that the policies and practices pertaining to the membership of our organization do not discriminate based on sex, race, religion, color, ancestry, national origin, marital status, handicap, age, or lifestyle.
ARTICLE B-III. Meetings.
-Section 1: Executive Meetings.
-Meetings are presided over by the President or the next highest ranking officer if the President is not there.
-All Executive Board members are required to attend (See Bylaws, ARTICLE B-II, Section4).
-The meetings shall be open to P.E.A.N.U.T.S. Core members, with other exceptions granted by the President.
-Only elected P.E.A.N.U.T.S. Executives have voting rights and half of the members of the Executive Board must be present for a vote.
-A motion must be passed with a two-thirds vote.
-Meetings are held as necessary, but no fewer than two per month.
Section 2: General Meetings.
-Meetings are open to the entire TCNJ community.
-Meetings are run by the President, or highest ranking Executive present at the meeting.
Section 3: Notification of Meetings.
-The secretary will notify members of meeting times and places through mailings, phone mail, or e-mail.
ARTICLE B-IV. Major Law Violations.
-Elected Executives’ neglecting of duties.
-Elected Executives’ repeated failure to attend regularly scheduled general or executive board meetings.
-An Executive may be removed from office with a formal petition, rebuttal, and a three-fourths majority Core and Executive member vote. Half of the core and executive board must be in attendance. Nominations for the vacated position will be held at the next meeting and elections the following meeting. The impeached official will not be eligible for future elections.
-The position of the impeached official is to be filled using the formal election process.
ARTICLE B-V. Amending the Constitution and Bylaws.
-The Executive Vice President forms and runs a committee to revise the Constitution and Bylaws every Spring Semester.
-Any Executive or core member may join the committee.
-Proposed changes are tabled at the next Executive Board meeting, discussed, and voted upon. A two-thirds majority must pass the proposed change.
-If proposals are rejected, they can either be thrown out or revised by the Executive board.
-The Executive Vice President makes the changes to the Constitution and/or Bylaws.
ARTICLE B-VI. Advisor.
-The advisor must be a member of the TCNJ faculty, administration, or staff who is interested in the views of P.E.A.N.U.T.S..
-ADEP (Alcohol & Drug Education Program) staff members are given first priority.
-A new advisor must be voted upon by Executives and core members.
ARTICLE B-VII. Honorary Members.
-Honorary members do not have voting rights at officer elections, but are welcome to all meetings and activities.
-The President of The College of New Jersey will be considered an honorary member during his/her term as President.
-Matt Bellace (founder of C.A.L.V.I.N. & H.O.B.B.E.S.), Dominic F. Santillo (first President and founder of P.E.A.N.U.T.S.), and the first Executive Board of P.E.A.N.U.T.S. (Nicole Vitulli, Leigh Belz, Shairna Curtis, Andrea Jost, Steve McGrath, Jenny Frett, and Dave Sansevero) shall be Honorary Lifetime members.
-Every President of P.E.A.N.U.T.S. will become an Honorary Lifetime member after his/her term has expired. The following former Presidents of P.E.A.N.U.T.S. are: Dominic Santillo, William Quirk, Jason Krum, Kelly Holland and Morgan Farnkopf.
-All T.I.G.S. (Teen Institute of the Garden State) office staff members are to be considered Honorary members during their employment at the T.I.G.S. office.
-Every President of our sibling organizations shall be Honorary members during their terms as President.
-Honorary Lifetime members may be nominated by any P.E.A.N.U.T.S. members at any time. A unanimous decision by the Executive Board must be reached as well as ninety percent of the core membership in attendance.
ARTICLE B-VIII. Sibling Organizations.
-Any organization at other colleges or universities that promotes the same general mission statement and participates in joint substance-free activities shall be considered for status as a sibling organization.
-A sibling organization must be approved by a unanimous vote of the P.E.A.N.U.T.S. Executive Board. -Should a sibling organization disband, it will no longer be considered such.
-P.E.A.N.U.T.S. currently recognizes C.A.L.V.I.N. & H.O.B.B.E.S as a sibling organization.
ARTICLE B-IX. Activity Committee Chairs.
-Vice President of Activities appoints committee chairs as necessary.
-Committee chairs organize events in cooperation with the Executive Board and committee members.
-All committee chairs report to the Vice President of Activities.
